Welcome to traq.to! By accessing or using our service, you agree to these Terms of Service.

Important: traq.to is currently in beta testing. This means the service is still under development and may contain bugs, errors, or incomplete features. Use at your own risk.

Beta Program Terms

No Guarantees:
As a beta service, traq.to is provided “as-is” without any warranties or guarantees. We make no promises about reliability, availability, accuracy, or functionality.

Expect Changes:
We may modify, suspend, or discontinue any part of the service at any time without notice. Features may be added, changed, or removed during the beta period.

Potential Data Loss:
While we strive to protect your data, beta testing may result in data loss or corruption. We strongly recommend maintaining backups of any important information.

No Service Level Agreement:
We do not guarantee any uptime or performance levels during the beta period. The service may be unavailable, slow, or unstable at times.

Your Account

Registration:
You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials.

Age Requirement:
You must be at least 16 years old to use this service.

Account Security:
You are responsible for all activities that occur under your account. Notify us immediately at hello@traq.to if you suspect unauthorized access.

Acceptable Use

You agree not to:

• Use the service for any illegal purpose or violate any laws
• Attempt to gain unauthorized access to our systems or other users’ accounts
• Upload malicious code, viruses, or harmful software
• Harass, abuse, or harm other users
• Attempt to reverse engineer or extract the source code
• Use the service to send spam or unsolicited communications
• Scrape or collect data using automated means without permission
• Impersonate any person or entity

We reserve the right to suspend or terminate accounts that violate these terms.

Payments and Subscriptions

Beta Program - Free Access:
As a beta tester, you can use traq.to completely free of charge during the beta period. No payment information is required during beta testing.

After Beta:
When the beta period ends and we launch officially, beta testers will receive attractive, preferential pricing as a thank you for helping us improve the service. We will notify you of the pricing details and transition timeline well in advance.

Billing:
Once the service transitions out of beta, payments will be processed through Stripe. By providing payment information, you authorize us to charge your payment method for the applicable fees.

Cancellation:
You may cancel your subscription at any time through your account settings or by contacting us at hello@traq.to. Cancellations take effect at the end of your current billing period.

Intellectual Property

Our Rights:
All content, features, and functionality of traq.to are owned by privacy/design GmbH and protected by copyright, trademark, and other intellectual property laws.

Your Content:
You retain all rights to the content and data you upload to our service. By using traq.to, you grant us a license to store, process, and display your content solely to provide the service to you.

Feedback:
If you provide feedback, suggestions, or ideas about the service, we may use them without any obligation or compensation to you.

Disclaimers and Limitations

No Warranties:
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRIVACY/DESIGN GMBH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR €100, WHICHEVER IS GREATER.

Beta Specific:
You acknowledge that beta software inherently contains bugs and defects, and you assume all risks associated with using such software.

Data and Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy.

We comply with GDPR and applicable data protection laws.

Termination

By You:
You may terminate your account at any time by contacting us at hello@traq.to or through your account settings.

By Us:
We may suspend or terminate your access immediately, without notice, if you violate these terms or if we decide to discontinue the beta program.

Effect of Termination:
Upon termination, your right to use the service ceases immediately. We may delete your account and data, though some information may be retained as required by law.

Changes to These Terms

We may update these Terms of Service at any time.

We will notify you of significant changes by email or through the service. Continued use after changes constitutes acceptance of the new terms.

Governing Law

These terms are governed by the laws of Germany.

Any disputes shall be resolved in the courts of Germany.
